What is ASCAP?

ASCAP is the American Society of Composers, Authors and Publishers, a Performing Rights Organization (P.R.O.). ASCAP's function is to protect the rights of its members by licensing and distributing royalties from the non-dramatic public performances of their copyrighted works. These royalties are paid to members based on surveys of performances of the works they wrote or published. ASCAP's customers, or licensees, encompass all who want to perform copyrighted music publicly: radio, television broadcasters, live concert promoters, symphony orchestras, shopping malls, bars, web sites, etc.

What is a Performing Rights Organization (P.R.O.)?

Under the U.S. Copyright Law, the creators and owners of copyrighted musical works (composers, songwriters, music publishers) have the exclusive right to perform or authorize the performance of their work publicly. That means that, generally, other parties cannot publicly perform copyrighted works without the permission of the copyright owner, and the owner has the right to be paid for the use of his or her intellectual property (musical work or song). Performing rights organizations represent musical creators and copyright owners by licensing, collecting and distributing royalties for the non-dramatic public performances of their copyrighted works. Performing rights organizations are clearinghouses for creators and users of music. The users, or customer licensees, encompass all those who want to perform copyrighted music publicly, such as radio and television broadcasters, cable programmers, live concert promoters, symphony orchestras, web sites, shopping malls, bars, etc.
Throughout the world, most performing rights organizations are set up as
membership associations of composers, songwriters and music publishers as is ASCAP, the American Society of Composers, Authors and Publishers, the leading performing rights organization in the world in terms of revenues and repertory.

MP3.com and ASCAP

MP3.com entered into a licensing agreement that permits ASCAP affiliated song writers and music publishers to post their repertory on the MP3.com Web site. The licensing fee paid by MP3.com to ASCAP shall be disbursed based upon the frequency with which their affiliated songs are streamed, downloaded or broadcast via the Web site.
